Apply Fair Sentencing Act Retroactively

New attorneys are being hired for Obama's "pardon push" -- Instead of pardons, please apply the Fair Sentencing Act retroactively like the United Nations​ recommends. For the U.S. to acknowledge that Blacks were sentenced 100:1 under racist sentencing laws but REFUSE to reverse harsh sentencing retroactively has left tens of thousands of young men and women languishing in America's #prisons for the "sin" of being black people. Pardons selectively release inmates as administrators see fit, whereas applying the Fair Sentencing Act indiscriminately would release prisoners who have served their time and some who have already been incarcerated substantially longer than they should have been. The "Daily News" reports:

"The Justice Department will drastically increase the number of attorneys it has on staff to deal with what is expected to be a massive push by President Obama to grant clemency to federal prisoners before the end of his term. The Office of the Pardon Attorney, which handles the federal government’s clemency cases, posted a job listing for 16 attorney advisors on the Justice Department’s website on Tuesday." http://dailycaller.com/2016/01/06/justice-department-plans-attorney-hiring-spree-to-keep-pace-with-obamas-pardon-push/

The term "pardon" implies an exception; a gift. It should not be exceptional for people to live free of racism imposed by their governments. It was wrong of Eric Holder to appeal the federal judge's decision to make the Fair Sentencing Act retroactive. Please correct that.

Small Victories, by AIMI

Assistance to the Incarcerated Mentally Ill (AIMI) is on air Wednesdays around midnight EST. Congressman Tim Murphy (PA-18) announced $15 million in funding for Assisted Outpatient Treatment (AOT) is included in the appropriations bill. Thank you for small beginnings, U.S. Congress. NAMI has pledged support for "Helping Familes in Mental Health Crisis Act of 2015," saying "Representatives Tim Murphy (R-Pa.) and Eddie Bernice Johnson (D-Texas) have introduced HR 2646, the 'Helping Families in Mental Health Crisis Act of 2015.' This introduction begins a legislative process toward mental health reform, which is long overdue. NAMI has submitted a letter of support to Representatives Murphy and Johnson indicating our appreciation of their leadership and our commitment to work with them to pass comprehensive mental health legislation." Research the bill online, and please urge your congressional representatives to support it. If they are not prison investors or bribed by private prison companies' lobbyists, they will support H.R.2646.

More people are becoming aware of the injustice of imprisoning rather than treating mental illness before crises because of AIMI. In prisons and jails, all mentally ill inmates are treated inhumanely, especially African Americans and Hispanics, who are starved to death, boiled to death, beaten to death, Tasered to death, baked to death, and driven to suicide by solitary confinement torture, all without any accountability being demanded of abusive corrections officers or their superiors. Mentally ill people are victims in more than 50 percent of police violence incidents. We attribute all three victories listed above to you, the People who stand up for the human rights of persons with serious mental illness. Homelessness, prison, and death must cease being America's response to serious mental illness. DeKalb County, Georgia Police Assaulted My Son: Alexyss Taylor

Human rights for prisoners is treated like hate speech by prison investors. Stalkers at Blogtalkradio have decided to prevent my photographs from showing on the billboard there. I suspect that is because somebody at Blogtalkradio is a prison investor. Tonight we interviewed Alexyss Taylor, whose son was allegedly attacked and brutalized by a police officer at DeKalb County Police Department, in Georgia in January 2015. Our guests recounted the most frightening night of their lives during our Human Rights for Prisoners March radio broadcast on the "Human Rights Demand" channel, March 2, 2015. Johnny Strozier, Keeping It Real


Johnny Strozier was imprisoned for 46 years (1968 to 2013), with 15 years in solitary confinement. He began a life of crime at 6 years of age, when he and friends broke into an Atlanta warehouse and stole cigarettes for family members and candy. Strozier continued to break the rules until he converted to Christianity in the 1980's. He talked about what it felt like to be a free adult for the very first time on NNIA1:

After his conversion, Strozier no longer attacked prison guards, escaped from prison, and participated in prison gang activity. He was a changed man. Strozier received his high school diploma behind bars and became a certified cook. He completed numerous other courses and attended church services regularly. Strozier's first year out of prison since he was a child has been exciting and challenging. He works, learned how to use a cell phone, still attends church regularly, and plans to learn how to operate a computer. He encourages our young people to avoid incarceration. Strozier's formula for wholesome living is simple:

1) Start thinking right; 2) start acting right; and 3) you will have the right results.

Strozier's story proves that everyone can change, and we should help prisoners to change their lives for the better. Rehabilitation should be the main goal of prisons. There are no throwaway people. Stalkers attacked my shows at +BlogTalkRadio and removed two of my recurring shows:

I wondered what the point was until I noticed that when I had to again post "Human Rights for Prisoners March," stalkers gave us a link with a "1" at the end. That way, the broadcast carrying Mr. Strozier's story will not match other "Human Rights for Prisoners March" shows recorded at Blogtalkradio. The other shows all have the exact same link, except the date changes automatically each week. Ask yourself why stalkers might conspire to prevent easy access to Mr. Strozier's uplifting story.

Could the stalkers be PRISON INVESTORS who want us to believe that there is no chance of rehabilitating prisoners and restoring them to wholesome lives? Like Mr. Strozier, I am also taking classes and praying. I am presently enrolled in the American Institute of Human Rights for the Human Rights Defender course. After 16 weeks of computer classes, Human Rights Defender candidates will train with International Human Rights Lawyers for six months. Stalkers destroyed my computer Sunday, necessitating that I purchase another one out of meager funds to continue my courses and online advocacy.

One day I plan to use my training as a Human Rights Defender to present a complaint against the many freedom of press violations I endure in the United States, which activists experience continuously. I am "America's Most Censored - Mary Neal" Google that title to access my article listing reasons why the statement is true. For now, I simply publish the assaults on my right to freedom of expression, report them to the Internet companies where they occur and to government officials who allow and/or order the violations, and save proof that my freedom of press rights are seriously violated. (The United Nations asks what measures have been taken in member states to correct crimes against humanity before it accepts complaints. That is why I report the violations and NOT because I expect positive Change from lawless people.)

Ida B. Wells' freedom of press rights were not respected in the 1800s. She published an anti-lynching report in her Memphis newspaper after several of her friends were arrested and lynched for attempting to protect themselves against certain Caucasian men, who happened to be off-duty sheriff's deputies. After publishing her report, Wells left Memphis and never dared return, lest she also become a lynch mob victim. Wells made the right decision. A mob assembled at her newspaper office the following day when her report was distributed, and they completely destroyed it. 

Activists, especially African Americans, still have difficulty reporting the truth in the United States. One of my online ministers, Rev. Edward Pinkney, is currently under a gag order that restricts his freedom of press rights. He is the very first American to have been issued a gag order to prevent him from using the Internet. His "crime"? Not kiddie porn, cyberstalking, bank fraud through online services, or any other criminal activity having to do with the Internet, although thousands of people have been convicted of such crimes without losing their right to use the Internet. Rev. Pinkney is accused, but not convicted, of election fraud for sponsoring a successful petition (with handwritten signatures) to recall the mayor of Benton Harbor, Michigan.

Despite the continuous censorship and sabotage of my work product, we continue our Human Rights for Prisoners March across the Internet, demanding respect for all people. It was encouraging to hear from Mr. Strozier, who was released as a changed man in 2013 after having lived as a prisoner since 1968 - the year Dr. Martin Luther King, Jr. was assassinated. We consider such testimony from a released prisoner plus the censorship that attacks his story as proof that our radio broadcasts have influence against mass incarceration, wrongful convictions, solitary confinement, capital punishment, and the fight for prisoners' rights as well as every American's human rights. Bob Darby has a B.A. in psychology from Emory University and has attended graduate schools in psychology and theology. He is a former employee of Georgia Regional Hospital, Boston State Hospital, and New Hampshire's Hanover-Darthmouth Hospital. In 1994, he founded Atlanta Food Not Bombs and has been an advocate for the homeless mentally ill for more than twenty years.

Elizabeth Gaskins will discuss how mentally ill people are subject to wrongful arrests rather than receiving proper care and treatment. We will discuss Jerome Murdough, a homeless Marine Corps veteran who suffered from schizophrenia and bipolar disorder who was arrested in Riker's Island jail and died there of overheating in a solitary jail cell in February 2014. Murdough essentially baked. Bob Darby will discuss how deinstitutionalization of the mentally ill during President Regan's term and simultaneous removal (through lack of funding) for the "safety net" of detoxification centers, group homes and outpatient treatment programs contributed to Murdough's avoidable death and the negligence of America's most vulnerable population. Jails and prisons have replaced hospitals for chronic mentally ill Americans.

Dr. Mustafa Ansari, an international human rights attorney and Dean of the American Institute for Human Rights, spoke about Jerome Murdough's death on Riker's Island during his radio show on March 26. Murdough is the homeless, mentally ill veteran who was baked in a solitary confinement cell in February.

The National Alliance on Mental Illness says that if they get the chance, eighty percent of bipolars and sixty percent of schizophrenics could be successfully treated to fully participate in mainstream society. But such treatment and medications are not currently available to many of them, because the new "atypical anti-psychotics" and other new drugs are expensive and must be professionally administered under in-patient supervision.

Picket Courthouses: Justice for Shannon Nyamodi

 QUESTION: How many of you are willing to picket for justice for Shannon Nyamodi at your own courthouses? His 6th Amendment right to a speedy, public trial is being violated to prevent his case from going to court. Even the alleged victim says Shannon is not the man who shot her. Elizabeth Crudup's son is being held in solitary confinement torture in Franklin County, NC jail. She has not seen him in months, and four(4) court dates have passed without the jail producing Shannon Nyamodi for trial. WHAT HAVE THEY DONE TO SHANNON TO FORCE A FALSE CONFESSION? IF HE IS MURDERED, THEN WILL YOU CARE ENOUGH TO PROTEST?

Today, Terrell Scott was released from a Pennsylvania prison after being indefinitely detained for 4.5 years to force a plea bargain. He was brutally treated - beaten, raped, exposed to HIV, and tortured with solitary confinement. He is now deaf in one ear and blind in one eye - all of that brutality was done to Terrell Scott. Officers of the court claimed Terrell Scott was too "crazy" for trial, but he was deemed competent for plea bargaining. Is this how prosecutors are allowed to avoid the embarrassment of losing court cases?

Shannon has been held without trial for nearly two years. Will you stand up for the Sixth Amendment by picketing for Shannon Nyamodi in your own city at your own courthouse, or do you await another black youth's corpse to get angry? Is this our children's future - indefinite detention until making false confessions to get out of jail? See the message from Elizabeth Crudup below.

Elizabeth Crudup They will not let me see or communicate with Shannon. We have had 4 Court dates, where they refused to produce him. Hoping to hear from Harvard law school criminal justice institute in the morning.

  
If Crudup fails to hear from Harvard Law, or if they offer no IMMEDIATE SOLUTIONS, we must protest for Shannon Nyamodi's immediate release or a soon court date that he is allowed to actually attend. Shannon is a youth in OUR village. Franklin County, North Carolina must not be allowed to capture an innocent black youth and treat him like a runaway slave. Our youths must not be indefinitely detained on indefensible criminal charges without our protest. Americans must not be denied their right to a speedy, public trial with competent counsel appointed, especially not working 18-year-old youths who graduated from high school and have no criminal background, like Shannon.

We congratulate Terrell Scott and his mother, Holly Alston, on his homecoming. It is an indictment against America and each of us that nothing was done to deliver Terrell Scott from the Pennsylvania prison before he suffered permanent injuries and confessed to crimes that never happened. A white woman lied on Terrell Scott after he reported her neglect and abuse of her children. His allegations were investigated and found to be valid, and the children were removed from her home. After that, according to an apology the woman delivered to Terrell's brother, she wanted to retaliate. Shannon suffered behind bars for the next 4.5 years with his right to trial denied. This must not be the fate of Shannon Nyamodi, especially since even the supposed victim said Shannon was not her assailant.

On Monday, March 17, 2014, assemble with concerned citizens at a courthouse in your own area, either at lunchtime or after work, and protest Shannon Nyamodi's continued indefinite detention and denial of his Sixth Amendment right to a trial. If anything changes in his circumstances before March 17, I will publish it here. Meanwhile, please proceed and make plans to picket the injustice system for justice.

Justice for Juan Rojas: Release the Innocent

Thousands of innocent people are released from incarceration every year. Most of them are released because they served their sentences. Between 5k and 10k people are wrongfully convicted each year. The Univ. of Mich. Law School Innocence Clinic says most wrongful convictions are caused by:

Eyewitness Misidentification - This is the single greatest cause of wrongful convictions nationwide.
Junk Science - Many forensic testing methods are applied with little or no scientific validation and with inadequate assessments of their significance or reliability.
False Confessions - Innocent defendants sometimes make incriminating statements, deliver outright confessions, or plead guilty.
Government Misconduct - Sometimes government officials take steps to ensure that a defendant is convicted despite weak evidence or even clear proof of innocence.
Snitches - Often, statements from people with incentives to testify help convict the innocent.
Bad Lawyering - The failure of overworked or corrupt lawyers to investigate, call witnesses, or prepare for trial.

The U.S. Supreme Court has not determined that actually innocent people have a right to have their post-conviction evidence considered by courts. We will consider it on this show and make a human rights demand to "Release the Innocent" every Saturday at 3:00pm EST.
