Eric Holder Resigns as Attorney General

Eric Holder Is Resigning. It is not known if CoIntelPro agents will be reassigned or keep their existing targets while a new AG is found and confirmed. Noteworthy work:
(1) Won an appeal against Judge Forrest's order calling NDAA's Section 1021 unconstitutional.

(2) Won an appeal to stop the Fair Sentencing Act from being applied retroactively for people overly sentenced under the 100:1 racist cocaine sentencing law.

(3) Built hope in the Clemency Project 2014 but failed to authorize defense attorneys to participate, which was said to render the large clemency drive a dud.

(4) Protected murderers in Shelby County, Tennessee who secretly arrested and killed mentally, physically disabled Larry Neal. Refused to investigate the government cover-up conspiracy and ignored requests to remove surveillance and interference against the Neals' communication.

(5) Allegedly stopped a federal investigation regarding the deaths of black young men on SJSU campus, namely Gregory Johnson, Jr., a student who was killed in November 2008. His murder was called a suicide. Parents of Brenden Tiggs, the school's latest "suicide," filed a lawsuit in 2014.

(6) Was instrumental in fighting New York's racist Stop & Frisk program and Mississippi's "school to prison" pipeline.

(7) During Holder's tenure, the DOJ certified assisted outpatient treatment (AOT) programs (which provide subsistence assistance plus mandated psychiatric treatment).

(8) Holder spoke favorably about removing the federal mandatory minimum sentencing for certain offenses.

If you have comments regarding Holder's six years as AG, please add them in the comment field below.

Before Mr. Holder goes, he will help the Department of Justice launch a new program today in partnership with the White House, the Department of Homeland Security, and the National Counterterrorism Center that will train "community leaders" like teachers and social workers to monitor their communities for signs of radicalization. If the trainees think they have observed burgeoning radicalism, they are to report the potentially radicalized person(s) to law enforcement so the government can intervene before any crime has been committed.

NOTE: Suppressing justice for African Americans killed during secret arrests or in predominately white colleges and universities may fall under the DOD or Homeland Security, in which case Holder's resignation will have no effect on the First Amendment violations, stalking, and terrorism. In fact, black families who ask about murders of family members by police or white elitists may be considered "radical" and unacceptably audacious. No clear definition of "radicalized" was given in the article announcing the new DOJ program.

Historic Clemency Drive a Dud

The Justice Department's promises about clemency reached a snag. This seems to be another case of, "Give us credit; we tried to do the right thing." And the crowds cheer in their mass hypnosis. Al Jareeza reports "Ambitious effort to extend presidential clemency to thousands of inmates is at risk of stalling because of a legal snag." "I tried" and a dollar won't buy a bag of chips. Never has any presidential administration "tried" to do so much for Americans, particularly blacks, and actually accomplished so little. It is incredible. See an excerpt below.

Federal defenders potentially excluded from historic clemency drive

Six months after the Justice Department called on defense lawyers to help it identify and vet candidates for its clemency drive, there is concern that the federal defenders — whom the DOJ invited in as key partners — might never have been authorized to participate in the first place. This could leave the initiative without the manpower it needs.

A high portion of the potential pool of inmates is represented by the federal defenders, and they have been critical in the formation and operation of Clemency Project 2014, a coalition of defense lawyers and advocates created in the wake of the DOJ’s call. (The vast majority of those prosecuted in federal courts receive court-appointed lawyers; in districts where there is a federal defenders’ office, they generally handle 60 percent of those cases.)

"Federal defenders include some of the best courtroom and appellate advocates in the United States. Having them work with the Clemency Project 2014 has been important to the work we are doing,” said Mark Osler, director of the Federal Commutations Clinic at the University of St. Thomas in Minnesota, who has been training lawyers for the Clemency Project. “Losing them as a part of the coalition would be a significant challenge.” Read the entire article:

The Truth About Clemency

The video embedded below was surreptitiously removed from my "Legal Victories" group at Facebook. It was also substituted in my "Legal Victories" blog with a video of Eric Holder discussing the Voting Rights Act. When Holder made the announcement at the April 21 speech (YouTube link http://youtu.be/GRy2bsUMuoE ) about clemency being considered for possibly thousands of inmates, threats to recall and prosecute the attorney general increased significantly.

"Attorney General on Expanding Clemency Criteria for Drug Offenders in Federal Prison"

See the redirected link in the last paragraph of "Legal Victories Expected re Clemency" at http://legalvictories.blogspot.com/2014/04/legal-victories-expected-re-clemency.html . Holder recently stated that 23 months would be cut from qualified inmates' sentences. That seems to be a Change from the expectations raised regarding clemency by Attorney General Holder in this video, and perhaps that explains why the video of his April 21 speech was removed from Facebook where I placed it and the link to this speech was redirected in my "Legal Victories" article to a speech about Voting Rights. Cyberstalking Mary Neal happens often. I am "America's Most Censored - Mary Neal" (Google it).

Thousands of America's inmates were sentenced under the 100:1 crack to powered cocaine law that the government later declared to be unjust and racist. The disparity was REDUCED but not eliminated under the 2010 Fair Sentencing Act. The present disparity is 18:1. Last year, President Obama granted clemency to eight victims who were unjustly given long sentences including life in prison for crack cocaine offenses under the old law, which was never applied retroactively to inmates who were sentenced before 2010. To cut only 23 months off the sentences of such individuals seems minuscule.

The United Nations made a recommendation in March 2014 that the Fair Sentencing Act should be applied retroactively to inmates who were sentenced under the unjust 100:1 law, which was admitted to have been racist. The federal mandatory sentencing law keeps thousands of individuals contained at great expense to taxpayers - people who would otherwise already be free if not for the racism in America's injustice system.

Referring to the United Nation's assessment of human rights in the United States that was issued in March, Al Jazeera reported, “[The] committee continues to be concerned about racial disparities at different stages in the criminal justice system, sentencing disparities and the over-representation of individuals belonging to racial and ethnic minorities in prisons and jails.”

"The U.N. body calls on the U.S. to retroactively implement the 2010 Fair Sentencing Act and close a loophole that allows thousands of nonviolent offenders to languish in federal prisons as a result of draconian drug laws."

Maine Criminalizes Mental Illness

A RECENT REQUEST to Assistance to the Incarcerated Mentally Ill :

Hi, everyone. My name is Steve Lewicki and I am the Coordinator of the Maine Prisoner Advocacy Coalition. We've got a desperate situation in Maine with correctional officers working at the state psychiatric hospital using Tasers, pepper spray, and force on patients. There is also a bill to transfer 30 people who have been deemed incompetent to stand trial or not responsible for their crimes to the state's max prison. Is there anyone that can advise me on strategies to improve and/or prevent this?
_____
Below is a video that demonstrates the issues that Mr. Lewicki describes in Maine: "Mentally Ill in Prisons" at YouTube http://youtu.be/9MOTKHlhKeY . If you have suggestions for Mr. Lewicki, please post them as comments here, or TRY to email me at MaryLovesJustice@gmail.com . Emails and phone messages not answered within 24 hours were not actually received. (I am censored. Municipalities are under contracts with private prisons and jails to keep them at a certain occupancy.) If you have influence over Maine, please address these inhumane, immoral conditions. WHY on earth are correctional officers working in mental hospitals? Why are mental hospital inpatients being treated like prisoners in War on Terror camps and controlled with Tasers, pepper spray, and FORCE instead of having compassionate, skilled hospital staff who use tranquilizers, straight jackets, and rubber rooms? Why are mental patients who were found to be incompetent to stand trial being imprisoned instead of hospitalized in Maine?

Can you help with this situation, Governor Paul LePage?

Can you address these issues, Mr. Joseph Pointe, Commissioner of the Department of Corrections in Maine?
http://www.maine.gov/corrections/admin/index.htm

Can you help your institutionalized mentally ill patients and inmates in Maine, Mr. Romney?

Is there something you can do about brutality to the mentally dysfunctional citizens in Maine, Senators?

The United States Department of Justice is responsible for protecting the rights of disabled Americans and all institutionalized persons. Will you address the abuses against the mentally ill in Maine hospitals and prisons, Attorney General Eric Holder?

Why are hospitalized mental patients being TASERED, sprayed with pepper spray, and strong-armed into submission by prison guards? Are dogs treated that badly in Maine's kennels? Does "maximum security" mean SOLITARY CONFINEMENT TORTURE? Does the law permit Maine's most vulnerable citizens to be denied trials and committed to PRISONS? Only 60% of the nation's incarcerated mental patients receive psychiatric treatment behind bars.
The budget for National Defense Authorization Act (NDAA) for 2013 was $639.7 billion. Please consider using part of those funds to provide substantial mental hospital space in Maine and every state, plus make assisted outpatient treatment (AOT) programs available for mental patients exiting jails and hospitals. Especially after the recent Navy Yard killings, American officials must realize that removing barriers to timely treatment for mental illness is providing "national defense."
We recognize that municipalities may have contracts with private prison owners to keep their facilities filled to a certain capacity, as reported by "Think Progress" at  http://thinkprogress.org/justice/2013/09/20/2658701/private-prison-firms-quotas-cells-coffers/ , but the mentally ill must not be reduced to prison commodities. Decision makers over Maine and the USA, please do unto others as you would have them do to you and your sick or addicted family members. Please do not Taser, pepper spray, and brutalize the mentally ill, and do not continue to sentence acute mental patients to prison without trials. We live in the 21st century, not the Middle Ages. Justice Clarence Thomas has a sick nephew, and Vice President Joe Biden has a niece who causes him concern. Every family has someone who is mentally ill, a condition affecting one in five Americans to some degree.

Please give ASSISTANCE TO THE INCARCERATED MENTALLY ILL in the State of Maine and throughout America. Officials over justice in Maine should contact Prisoner Advocacy Coalition and advise Mr. Lewicki of appropriate actions that will be taken in connection with his request.

Mentally Ill in Prison, a video by nstephenson2

Note: The narrator of the film showed a picture of Larry Neal and misrepresented him as being another mentally ill man who was arrested for child support and killed while in custody. Larry Neal was actually secretly arrested for 18 days and murdered in Memphis Shelby County Jail in 2003 by means that have not been disclosed.
